Article XI – SCHOOL COMMITTEE
Section – 11.01 Composition, Eligibility, Election, Tenure of Office
Composition. The school committee shall consist of five
members selected by the legally qualified voters of said City.
Eligibility. Only qualified voters of the City shall be eligible
for election to the school committee.
Elections, Tenure of Office, Special Provision. School committee members shall hold office for a term of three years, except that at the first election held after the adoption of this charter the candidate having the highest number of votes shall be elected for a term of three years, and the candidate having the next highest number of votes shall be elected for a term of two years, and the candidate having the next highest number of votes shall be elected for a term one year. Thereafter, two members shall be elected annually for a three-year term, excepting that every third year only one member shall be elected for a three-year term. Each member shall serve until his his/her successor is duly elected or qualified. Any vacancy occurring due to
death, resignation, removal from the City or removal from office shall be filled by a 3/5 vote of all the members of the city council and the new member shall be elected to fill the vacancy for the unexpired term, if any.
Forfeiture of Office A school committee member shall forfeit
his his/her office after a public hearing if he he/she:
Lacks at any time during his his/her term of office any
qualifications the office prescribed by this charter or by law.
Violates any express prohibition of this charter.
Is convicted of criminal homicide 1st or 2nd degree, a class
A, B, C, D crime involving moral turpitude, or
Fails to attend three consecutive regular meetings of the
committee without being excused by the committee.
Compensation School committee members shall receive only the actual and necessary expenses incurred in the performance of the duties of office.
Section – 11.02 Organization, Qualification, Quorum.
The school committee shall meet for organization within seven days from date of election. The members elected shall be sworn to the faithful discharge of their duties. This will be by a justice of the peace or by the city clerk, and a record made thereof. A majority of the whole number elected shall be a quorum and shall elect their own chairman.
Section – 11.03 Powers, Duties.
The school committee shall have all the powers, and perform all the duties in regard to the care and management of the public schools of said City, which now conferred and imposed upon school committees by the laws of this state. They shall elect a superintendent of schools as provided for by the laws of the state, who shall have the care and supervision of said public school, under their direction, and act as secretary of their committee; they shall fix their salary at the time of his election. They shall annually, as soon after the organization of their committee as practicable, furnish to the city council an estimate in detail of the several sums required during the ensuing municipal year for the support of the public schools. On the basis of such estimate the city council shall make one gross
appropriation for the support of public schools for the ensuing municipal year, and such appropriation shall not be exceeded except by consent of the city council, but the expenditure of said appropriation shall be under the direction and control of the school committee.
